MINISTRY OF PUBLIC WORKSOPEN NATIONAL INVITATION TO TENDER No 082/AONO/MINTP/CMPM/2018 of 17/10/2018 FOR THE EVALUATION OF THE IMPACTS OF ECONOMIC PARTNERSHIP AGREEMENTS ON THE CONSTRUCTION PRICES OF INFRASTRUCTURES LAUNCHED BY THE MINISTRY OF PUBLIC WORKS.
Financing: MINTP Investment Budget, Line: 36 470 03 33 00115 2029On behalf of the Government of Cameroon, the Minister of PublicWorks, Project Owner, hereby issues a Open National Invitation totender for the conduct of the above study.
1.OBJECT :The tender concerns, the evaluation of the impacts of economicpartnership agreements on the construction prices ofinfrastructures launched by the ministry of public works.
2.ALLOTMENT : The works shall be tendered for in one (01) lot as follows:Study Amount (CFAF)Evaluation the impacts of economic partner-ship agreements on the construction prices 21 000 000 of infrastructures launched by the Ministry of Public Works.
3.SCOPE OF WORKS :The works shall comprise the following tasks :a) show the situation of the infrastructural sector in Cameroon;b) draft a model for the analysis of EPA effects and impacts onthe public works and civil engineering sector;c) evaluate the impact of EPA on the public works and civilengineering sector;d) make a comparative analysis after the implementation ofthese agreements;e) propose measures to capitalize the opportunities offered byEPAs and reduce their negative effects on the public worksand civil engineering sector.
4. ELIGIBILITY :Otherwise, the contractualisation of this market will have passed inCall of offers Opened in accordance with the article 78 paragraphs3 of the N°2018/366 decree of June 20, 2018, that stipulate that"the Mr. of Work or the Mr. the can be exempted of Work Delegatepre-qualification for intellectual benefits raising some lettersorders ".
5. FINANCING :Works under this tender shall be financed by the Budget of theMinistry of Public Works for the 2018 Financial Year, Line: 36 47003 33 00115 2029. The total estimated cost shall stand at 21 000000 (twenty one million) CFAF, inclusive of taxes.
6.TIMEFRAME :The overall execution timeframe shall be three (3) calendar months,mobilization depending on the effective duration of the works.
7.CONTRACTING AUTHORITY :Following the evaluation of offers, the contract shall be signedbetween the successful tenderer and the Minister for Public Works.
8.ACQUISITION OF TENDER DOCUMENTS :The tender documents may be obtained at the MINTP Sub-Department of Public Contracts, Tenders Service, situated on theground floor of KEANO Building, located behind the building hostingthe Special Taxation Registration Unit (see paved entrance) Mvog-Ada quarter, upon presentation of a receipt of payment into thePublic Treasury of a non-refundable fee of thirty thousand (30 000)CFA F.Such a receipt shall identify the payer as representing thecontractor willing to participate in the tender.
9.PROVISIONAL GUARANTEE (BID BOND) :Tenders shall include a provisional guarantee (bid bond) of a validityperiod of onehundred and twenty (120) days, with effect from the initial tender-submission date and issued in keeping with the tender model by afirst class banking institution approved by the Minister of finance.The amount shall stand at four hundred thousand (400 000) CFA F.Lest it be rejected, the provisional guarantee must be the originaldating less than three (3) months old.The provisional guarantees of unsuccessful tenderers shall bereleased automatically at most thirty (30) days with effect from theexpiration of the tender validity. That of the successful tenderershall be released after the constitution of the definitive guarantee.
10.CONSULTATION OF TENDER DOCUMENTS :The tender documents may be consulted at the MINTP Sub-Department of Public Contracts, Tenders Service, situated on theground floor of KEANO Building, located behind the building hostingthe Special Taxation Registration Unit (paved entrance) Mvog-Adaquarter.
11.PRESENTATION OF TENDERS : The tender constituent documents shall be presented in thefollowing three volumes enclosed in a double envelope:➢ Envelope A containing the Administrative documents(Volume 1) and the Technical proposal (Volume 2);➢ Envelope B containing the Financial offer (Volume 3);➢ Envelope C containing an additional copy of the financialoffer (sealed pilot offer) which will be transmitted to theorgan in charge of regulation of public contracts forconservation, in keeping with article 92 (8) of decree Nà2018/366 of 20 June 2018 to lay down public contracts.All the constituent documents (envelopes A, B and C) shall beenclosed in a sealed outer envelope bearing only the subject of thetender concerned.The different documents of each offer shall be numbered in theorder indicated in the tender and separated by dividers of the samecolour other than white.

13. TENDER COMPLIANCE :➢ Tenders not respecting the separation mode of theadministrative document, thetechnical proposal and thefinancial offer, or not containing the sealed pilot offershall be rejected.➢ Any offer not in keeping with the tender requirements,especially the absence of the provisional guarantee,issued in keeping with the tender model by a first classbanking institution approved by the Ministry of Financeand valid for a period of thirty (30) days with effect fromthe tender validity deadline shall be rejected.➢ Lest they be rejected, shall be submitted only theoriginals or true copies of therelevant administrativedocuments, certified by the issuing service in keepingwith the requirements of the Special Tender Regulation. ➢ Before any rejection, the consultants with compliantadministrative documentsshall be allowed an additionalperiod of at least 48 hours either to provide furtherinformation or to carry out other verifications on thevalidity of the documents received.➢ They must date no more than three (3) months old on theinitial tendersubmission deadline.
14. OPENING OF TENDERS :Tenders shall be opened in two stages. • The administrative documents and the technicalproposals shall be opened by the MINTP Tenders Boardon 20/11/2018 at 2 p.m in their meeting room situatedat the Centre Regional Delegation of Public Works,behind Hôtel des Députés, Younde.• Only tenderers may attend the opening session or eachhave themselves represented by only one dulymandated person of their choice with sound knowledgeof their file.• Following the examination of the administrativedocuments and the evaluation of the technicalproposals, the financial offers shall be opened under thesame conditions on a later date to be communicated totenderers with the compliant administrative file andhaving scored a technical mark of at least 70 out of 100points.
15.TENDER EVALUATION CRITERIA :15.1Eliminatory criteria :a) Administrative file➢ Absence of provisional guarantee;➢ Absence of a deadline of 48 hours following thenotification to the company, of at least one of theadministrative documents except the provisionalguarantee;➢ Non-compliance after 48 hours following the notificationto the company, of at least one of the administrativedocuments;➢ False declaration, forged or non-authentic document;b) Absence in the technical proposal of:➢ Former declaration attesting that the tenderer has notabandoned a contract during➢ the past three (3) years and that he is not on the list ofdefaulting contractors➢ published by MINMAP;➢ Analysis of the works to be executed, the technicalapproach and the➢ methodology envisaged;➢ A mission Head with the relevant qualification;c) False declaration or forged documents;d) Omission in the financial offer of a quantified unit price;e) Absence of a quantified unit price in the financial offerf) Failure to score a technical mark of at least 70/100.15.2Essential criteria :Technical proposal :The technical proposal shall be evaluated as per the followingessential criteria:a) Qualification of experts and their experience in theproject’s field out of 14 points;b) Technical resources and equipment to be put in place perlot tendered for out of 60 points;c) Equipment and financial resources to be put in place; 14points;d) Consultant’s references out of 10 points;e) Mission understanding 02 points;
FINANCIAL OFFER :Only the financial offers of tenderers with the pre-selectedtechnical proposals after the examination for compliance of theadministrative documents (stage 1) and the evaluation of thetechnical proposal (stage 2) shall be assessed as per the followingcriteria:NM = MMd x 100 / MSNM = Tenderer’s financial offer mark;MMD = Lowest bidder’s avaluated amount;MS = Tenerder’s evaluated amount.The technical mark and the financial mark shall be weighted toobtain a final mark N (technico-financial mark) according to thefollowing formular:N = [(70 x Technical mark) + (30 x Financial mark)] / 100
16.TENDER VALIDITY :Tenderers shall be bound by their tenders for a period of ninety (90)days with effect from the tender-submission deadline.
17.CONTRACT AWARD :The contract shall be awarded to the tenderer with the lowest bid,that is having scored the highest overall mark and deemed to beessentially in keeping with the tender file.A tenderer may be awarded a maximum of one (1) lot.
